Law 4/2017, of July 13, on the ground and of natural spaces

The res.of May 9, 2018, of the General Secretariat of Territorial Coordination, which publishes the Agreement of the Bilateral Cooperation Commission General Administration of the State-Community of the Canary Yoslands in relation to Law 4/2017, of July 13, from the soil and the protected natural spaces of the Canary Yoslands («B.ANDYoTHANDR.Yo.C.»May 16/« B.ANDYoTHANDR.AND.»May 16) declares that:

ANDn relación a las discrepancias manifestadas sobre el artículo 2.2.d) And article 176.1.6 of Law 4/2017, of July 13, both parties consider that the reference to the "marine territorial scope" contained in article 2.Section 2, letter d), must be interpreted in accordance with state legislation and the jurisprudence of the Constitutional Court, taking into account the different sectorial areas of application on which said powers are projected.

Specifically, in matters of protected natural spaces, the jurisprudence of the Constitutional Court established in the STC 38/2002 of February 14 is applicable. ANDn su virtud, esa referencia al «ámbito territorial marino» ha de considerarse exclusivamente válida respecto de las competencias de la Comunidad Autónoma en materia de espacios naturales protegidos cuando «exista continuidad ecológica de un espacio natural terrestre con el espacio marino» avalada por la mejor evidencia científica existente, de conformidad con la legislación estatal básica, y en particular con el artículo 37 de la Ley 42/2007, de 13 de diciembre, del Patrimonio Natural y de la Biodiversidad, y las determinaciones del ANDstatuto de Autonomía.
